Litigation
Our litigation/ADR lawyers’ expertise varies from advice on conflict avoidance and pre-litigation strategic counselling to full litigation representation before judicial bodies. When appropriate, ADR techniques such as early neutral evaluation, executive tribunals, non-binding and binding expert opinion procedures, adjudication boards, mediation and conciliation are employed to achieve a cost-effective resolution.
When that is not possible, our team is equipped to employ more traditional litigation methods and aggressively pursue and represent our clients’ interests. At all times we remain quite conscious that those interests often demand quick pragmatic solution.
Given the international accent of our litigation practice, we are often involved in multi-jurisdictional litigation and in that regard are called upon to act as co-coordinating counsel to oversee the work of correspondent law firms representing a client in other jurisdictions. With team members coming from both common law and civil law jurisdictions, we are uniquely qualified in this respect in the Netherlands. Likewise, we also assist in employing evidence gathering (discovery) procedures and conservatory attachment orders in the Netherlands in aid of foreign-based proceedings. Insurance and Liability Disputes: we regularly represent both insurance carriers and insured parties in regard to coverage disputes as well as litigation arising out of claims for general and specific types of liability and casualties.
Construction and Engineering Industry Disputes: one of the core industry sectors which we represent is companies in the construction and engineering industry where we regularly act on behalf of parties involved in major disputes over large industrial projects.
Information and Entertainment Industry: our experience includes litigation before the Dutch national courts in disputes regarding among others trademarks, tradenames and other intellectual property rights including patents.

Alternative Litigation/ADR
The benefits of mediation and conciliation techniques for the resolution of disputes is becoming increasingly recognized among parties dissatisfied with the long delays often experienced in the national court systems. Our ADR practice includes advising parties on which techniques are best suited to their situation as well as representing clients in these various procedures. Internationally, these procedures are often used to resolve differences between parties from different jurisdictions involved in cross-border commercial litigation or arbitration.
Our ADR practice is led by Shawn Conway, a recognized expert in this field who has advised large corporations as well as the European Parliament on the use of various methods of ADR such as mediation, early neutral evaluation, and expert opinion procedures. The lawyers of our ADR practice regularly act as mediators and neutrals for international or domestic disputes, as well as counsel on behalf of parties involved in such disputes. For ADR procedures conducted in the English language and/or involving international or cross-cultural disputes, our team of American as well as Dutch lawyers is ideally suited to represent the interests of clients.
